Conditions of participation

Participation in the KubeCon + CloudNativeCon 2022 Nintendo Switch Lite competition by Codefresh, Inc. (“CodeFresh”), hereinafter referred to as the operator or organizer, is free of charge and is governed exclusively by these conditions of participation.

The procedure of the competition

The duration of the sweepstakes is from April 17, 2022, 09:00 am to May 20, 2022, 5:00 pm. During this period, users will be given the opportunity to enter the competition online on the competition page.


In order to participate in the competition, it is necessary to fill in and send the participation form displayed. Participation is only possible within the participation period. Entries received after the closing date will not be considered in the draw.

Only one submitted entry per participant will be entered into the competition. It is strictly prohibited to use multiple email addresses to increase your chances of winning.

Participation in the competition is free of charge.

Void where prohibited.

Eligible participants

Eligible to participate are natural persons who have reached the age of 18. Participation is not restricted to customers of the organizer and is not dependent on the purchase of goods or services.

Should a participant be restricted in their legal capacity, the consent of their legal representative is required.

Not eligible to participate in the competition are all persons involved in the conception and implementation of the competition and employees of the operator as well as their family members. In addition, the Operator reserves the right, at its own discretion, to exclude persons from participation if there are justified reasons, for example (a) in the event of manipulation in connection with access to or implementation of the sweepstakes, (b) in the event of violations of these conditions of participation, (c) in the event of unfair actions or (d) in the event of false or misleading information in connection with participation in the sweepstakes.


Winning, notification, and transmission of the prize

The following prizes will be awarded:

3 Nintendo Switch Lites will be given away. One winner will be chosen on May 15. 2 winners will be chosen on May 20 (1 virtual winner and 1 in-person winner). If the competition is linked to a task, only those participants who have completed the task correctly will be entered into the draw. The winners will be informed about the prize in a timely manner via a separate email.

The prize will only be handed over to the winner. An exchange, a self-collection as well as a cash payment of the prize are not possible.

Any additional costs associated with claiming the prize shall be borne by the winner. The winner is responsible for any taxation of the prize.

If the winner does not respond after two requests within a period of one week, the prize can be transferred to another participant.

Termination of the competition

The organizer expressly reserves the right to terminate the competition without prior notice and without giving reasons. This applies in particular to any reasons that would disrupt or prevent the sweepstakes from running as planned.


Except where prohibited, by participating in the competition, entrants agree to release and hold harmless Codefresh and its respective parents, subsidiaries, affiliates, and their respective agents and agencies, and their respective officers, directors, employees and agents (the “Released Parties”) from and against any claim or cause of action arising out of participation in the competition or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the competition; (b) technical errors related to computers, servers, providers, printers or telephone or network lines; (c) printing errors; (d) errors in the administration of the competition or the processing of entries/plays; (e) late, lost, or undeliverable mail; or (f) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the competition or receipt of any prize. Entrant further agrees that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the competition and in no event shall the Released Parties be liable for attorney’s fees. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages. If, for any reason, an entrant’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another competition entry; provided that if it is not possible to award another entry for any reason, Codefresh, at its discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any prize offered herein. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than stated number of prizes as set forth herein to be available and/or claimed, Codefresh reserves the right to award only the stated number of prizes by a random drawing among all legitimate, un-awarded, eligible prize claims.

Data protection

Participation in the competition requires the provision of personal data. The participant assures that the personal data provided by them, in particular their first name, last name, and email address are true and correct.

Except where prohibited, participation in the competition constitutes the winner’s consent to the operator’s use of the winner’s name, likeness, voice, opinions, biographical information, hometown and state for promotional purposes in any media, without further payment or consideration.

The organizer points out that all personal data of the sweepstakes participant will neither be passed on to third parties nor given to them for use without consent.

The participant may revoke their declared consent at any time. The revocation must be sent in writing to the contact details of the organizer stated in the imprint area of Codefresh. After the revocation of the consent, the collected and stored personal data of the participant will be deleted immediately.

Severability clause

Should any provision of these Terms and Conditions of Participation be or become invalid in whole or in part, the validity of the remaining provisions of these Terms and Conditions of Participation shall not be affected thereby. In place of the invalid provision, the legally permissible provision that comes closest in economic terms to the meaning and purpose expressed in the invalid provision shall apply. The same applies in the event of a loophole in these conditions of participation.
